LIABILITY WAIVER

While attending GoFitness World Wide Virtual or in Person classes, I agree that all exercises including the use of weights, number of repetitions, and use of any and all machinery, equipment, and apparatus designed for exercising, and the Instruction I receive is used at my sole risk. Notwithstanding any consultation on exercise programs which may be provided by gym employees or agents, it is hereby understood that the selection of exercise programs, methods and types of equipment shall be my entire responsibility, and GoFitness World Wide shall not be liable to me or members of my family for any claims, demands, injuries, damages, or actions arising due to injury to myself, person or property of myself of or in connection with the use of the services and facilities of the gym or the premises where the same is located. I also agree that Go Fitness Idaho is not responsible for any personal property, injury, loss or damage to any personal property, including but not limited to the parking area, loss due to theft, damage to vehicles, or car accidents. As a member, I hereby hold GoFitness World Wide, its successors, assigns, owners, officers, directors, employees, and agents harmless from all claims which may be brought against them by myself, someone on my behalf, my family members, family executors, administrators, and personal representatives for any such injuries or claims aforesaid and member for himself and on behalf of my family, executors, administrators, and personal representatives does hereby forever release and discharge GoFitness World Wide, it's successors, assigns, owners, officers, directors, employees, and agents from all claims, demands, injuries, damages, actions, losses and expenses. 

This section will survive any cancellation of this agreement.

I agree to keep and obey all the rules and regulations enforced by GoFitness World Wide, it's trainers and staff regarding the safe use of equipment, and reserves the right to revoke this membership for cause if member fails to keep and obey any such rules and regulations, or for reasons of nuisance, disturbance, moral turpitude or fraud. As a member, I also agree to always be considerate of other members rights and privileges, and to treat staff and members with the fullest respect and courtesy at all times.

I agree to pay the full membership price, or provide monthly payments each calendar month for the selected package term.

I am aware that this membership is non-refundable, non-transferable, and that late and non-sufficient funds are subject to a $25 NSF and late fee.

If for any reason I require a pause during my membership, I agree to pay a $20 hold fee per calendar month until I return to my regular membership. My regular membership fees, if paying monthly, will then resume. If I have paid in full, the added time will be added to my expiry date.

In the event of illness or injury, a doctor's note is to be provided in order to pause my membership, thereby waiving the $20 hold fee, and additional time will be added to my membership once the doctor agrees it is safe to resume.

If for any reason I decide to cancel my membership early while I am on a monthly payment plan, I agree to pay $50 to terminate my contract. This does not apply to paid in full Memberships.

I understand that failure to pay my fees and dues in a timely manner can result in collection action and/or small claims court.

ZERO TOLERANCE OF SEXUAL MISCONDUCT AND OR BULLYING

GoFitness World Wide is a safe space for individuals seeking self improvement, and does not condone the use of inappropriate sexual behavior or bullying. Anyone who engages in such behavior will be immediately terminated and charged for the remainder of their contract- due in full, upon termination. An additional $500 will be charged and added to existing fees for every client involved.
